 These terms & conditions form an agreement between GOLDEX EXCHANGE and the user (“you” or “your”). By registering, you indicate that you have read, agreed, and accepted our terms. You must stop using our platform if you do not agree to any of the terms stated below.

 Disclaimer: Information on the platform shall not constitute a recommendation, endorsement, or offer to enter into a financial transaction. You understand that investment is subject to risks and discussions of financial assets on the platform may contain risk factors. You are responsible to plan your investments to ensure that they are appropriate to your objectives and financial situation.

 Definitions

The terms below shall carry the meaning as follow:

(a)Authorised Individual: A person who can access and use the platform on behalf of a user.

(b)Digital Assets: This refers to cryptocurrencies.

(c)Digital Platforms: Third-party platforms such as Apple App Store and Google Play.

(d)Governmental Authority: Government or entity such as legislative, judicial, agency, or self-regulatory organisation.

(e)Material: This is defined as market data, research reports, or documentation provided through the platform.

(f)Personal Information: Information disclosed by a user.

(g)User: Any person who has registered with the platform.

 

Changes

We reserve the right at any time to:

(a)Modify, update or change the terms & conditions.

(b)Change the platform by eliminating content or discontinued features.

(c)Impose fees for the usage of the platform (with reasonable notice).

  

Registration Eligibility

You must be over 18 and legally allowed to enter into contracts with us. You must provide all necessary information when registering for an account and keep that information updated. We have the right to accept or reject any registration and only approved users are considered our customers.

Any resident, located in or otherwise attempting to access the GOLDEX EXCHANGE Platform or any of GOLDEX EXCHANGE services from, or otherwise acting on behalf of a person or legal entity that is resident or located in, a Restricted Location are not eligible to open an account with GOLDEX EXCHANGE. Your account is subject to immediate suspension with no further recourse. For the purposes hereof, “Restricted Location” shall include the United States, Canada, and such other locations as designated by GOLDEX EXCHANGE from time to time as a “Restricted Location” for the purposes hereof.

 

Intellectual Property

All ownership rights are reserved by us. Complying with the terms may allow you to enjoy our services. If you breach any of our terms, we can terminate your access to the platform.

You agree not to:

(a)Modify, reproduce, translate, or reverse engineer any data and content of the platform.

(b)Remove copyright, trademark, logo, or product identification from the platform.

(c)Misrepresent third-party sites as our platform with the “look and feel” of our intellectual property rights.

(d)Edit any part of the platform without authorisation.

(e)Make commercial use of the platform logo, trademark, or brand name.

 

Fees

Our platform is free to download but we may charge for certain in-app services. We reserve the right to modify the fee rate at any time, and such changes will take effect upon notice. If you have been charged an unknown fee, please notify us via email at [email protected].

  

Platform Disclaimer

The platform is provided on an “As Is” basis without any warranties to users. We do not guarantee the accessibility of the platform at all times.

Indemnification & Liability Limitation

You agree to hold responsibility for any claims (including liabilities, expenses, costs, demands, and legal fees) resulting from you. We shall notify you by email or other means to cooperate with the expense of such a claim.

We will not be liable for events that are beyond our control such as acts of God, war, civil commotion, system & processing failures, market collapse, natural disaster, government regulation or restriction, hacking, SPAM, or server failure.

 

Account Termination

We reserve the right to suspend any use’s access to the platform if they violate any of our terms. We may issue a warning to you regarding the termination if:

(a)It is necessary to protect the platform’s security.

(b)We detect any transactions that are deemed to be in violation of these terms.

(c)We suspect any digital assets or funds held in your account are associated with criminal activity.

(d)We are unable to verify or authenticate the information you provided.

(e)We are directed by governmental authority.

The platform shall not be liable for any termination of the user’s account and users shall not attempt to regain access to the terminated account without our prior written consent.

 

Records Conclusive

All transaction history and balance recorded in the system will be final and conclusive. Users agree that such records are admissible evidence and any rights to challenge the authenticity of such records are waived.
